General terms and conditions of GDH Transport und Container Logistik GmbH

GDH organizes especially container transport by truck, rail and inland waterway in the local and long distance in the lead or lag to / from European ports. GDH provides further services related to shipping containers, as picking, interim storage, unloading and packing and more. We work exclusively on the basis of the contractual terms for "Güterkraftverkehrs-, Speditions- und Logistikunternehmer (VBGL)", the latest version, the CMR for cross-border transports and our "Conditions of carriage in containertrucking".

Furthermore, the conditions of carriage for container transport of GDH are valid additionally with the placement of the order by the customer.

In § 29 VBGL the legal liability for damage to goods in multimodal transports, including sea transport is limited to 2 SDR / kg, the maximum per incident is restricted to an amount of € 1 million. Per loss event legal liability is limited to a maximum of € 2.5 million or 2 SDR / kg whichever amount is higher.

GDH adheres to offers until further notice, but not later than the dates given in the offers data. Any order covered by offers , which GDH performs for the customer up to that date, or until a revocation notice of the customer will be carried out on the terms of the respective offers and transport conditions for container transport. GDH points out that GDH can make use of the possibility of revocation in particular in the case of uncontrollable cost developments that may, for example but not only, based on changes in energy prices or the legal framework.

The calculation of the transport distance is based on PTV Map & Guide (latest version). An approved order confirmation by GDH is not a confirmation of the delivery date (acc. to § 21 VBGL). All prices given by GDH are excluding VAT, where it is applicable.

Unless other is specified in the offer, GDH will issue invoices after performance. Invoices are payable within 10 calendar days beginning with invoice date by payment to the specific billing account of GDH . Conflicting terms and conditions of contractual partners are only valid if GDH expressly and in writing agreed to their application. GDH explicitly contradicts general forms of the contractual in regards to their terms and conditions. Any verbal agreements between the customer and GDH does not exist. Deviating agreements must be in writing and require the validity of the confirmation by GDH.

German law shall apply

Jurisdiction and performance is Hamburg / Germany.
